Native Law

Our Indian law practice stems from a national reputation for economic development expertise on or near Indian Country.  Tribal governments, tribal members, tribal organizations and enterprises, individual tribal members, non-Indians, and clients doing business with or near an Indian tribe or reservation all benefit from our tribal expertise.  Moreover, in addition to tribal economic development, we practice in enrollment matters, federal tort claims, land claims, and all manners of Indian law outside of criminal law, ICWA, and self-determination contracts.

As the primary attorney assisting on Indian law matters, David Shaw draws on his years of experience living on a tribal reservation, acting as in-house counsel to tribal governments and corporations, and numerous speaking engagements before tribes and inter-tribal organizations.  At David D. Shaw, P.C., sovereignty and respect for tribal culture is not a topic that requires further explanation.  Instead, we serve to create legal solutions that build upon these foundation principles and the nuances of tribal culture.

Examples of routine transactions practiced by David D. Shaw, P.C. include the following:

  • Represent tribal regulatory agencies and parties appearing before such agencies
  • Provide analysis, advice, and transaction documentation for all manners of casino and resort development
  • Draft and foreclose security and financing and development agreements for property or entities on or near Indian country
  • Represent parties involved in tribal enrollment and disenrollment actions
  • Draft codes and ordinances for tribal governments
  • Provide representation on all matters relating to economic development, including development of tribal business entities, participation in the SBA 8(a) program, joint venture agreements, etc.
  • Prosecute and defend all forms of litigation, including issues related to tribal self-insurance or subrogation.
